Mylan hints at deals to strengthen specialty drugs business
(Reuters) - Mylan Inc raised its full-year earnings forecast, buoyed by rising generic drug sales in North America, and said it could be interested in acquiring specialty drugs to counter an expected slowdown in generic sales growth after 2013.
The expiry of patents on several blockbuster drugs stretches through 2016, but the biggest drugs will have lost their patent protection by next year.
Mylan, one of the world's largest generic drugmakers with more than 1,100 products, has not made a big acquisition since 2007, when it bought Germany's Merck KGaA's generics business for $6.6 billion.
Mylan is looking at acquiring companies that make injectables, topicals and dermatology products, Chief Executive Heather Bresch said on a conference call with analysts.
"I think in 2013 they start slowing down on the North American business and in 2015 they have got a generic EpiPen coming from Teva Pharmaceutical Industries Ltd, and that could be a meaningful impact on earnings," Louise Chen of Guggenheim Securities said.
Mylan has a whole host of drugs, but if they do an acquisition, then people can forecast growth over a couple of years instead of looking at it just on a quarterly basis, Chen added.
The company currently derives about 16 percent of revenue from its specialty drug business.
The generic drugmaker, which has a market value of $9.72 billion, is already involved in developing respiratory and biologics products. It also has a branded injectable anti-allergen product called EpiPen.
Mylan has marketable securities and cash and cash equivalents of $365.9 million as at September 30.
RAISES FULL-YEAR FORECAST
Mylan raised its full-year 2012 adjusted earnings forecast to between $2.50 and $2.60 per share, up from $2.45 to $2.55.
Analysts expect 2012 earnings of $2.52 per share, according to Thomson Reuters I/B/E/S.
The company posted an adjusted third-quarter profit of 83 cents per share, beating Wall Street estimates of 77 cents per share, according to Thomson Reuters I/B/E/S.
Total revenue rose nearly 15 percent to $1.81 billion, but fell short of analysts' expectations of $1.85 billion.
The company's generic revenue jumped 10 percent to $1.5 billion in the third quarter, as the expiry of patents on several blockbuster drugs expand the market for generics.
Sales in the Europe, Middle East and Africa (EMEA) region fell 7.2 percent to $325.6 million in the third quarter, hurt by price cuts in Europe and foreign exchange rate fluctuations.
Excluding the effects of a strengthening U.S. dollar, sales in the EMEA region rose 3 percent, helped by sales growth in France and Italy.
"Many of our European markets realized increased sales, an encouraging sign that the region may finally be turning a corner," CEO Bresch said on the call.
Susquehanna Financial Group analyst Gary Nachman said it was encouraging to see growth in Mylan's non-U.S. revenue.
"That has been something people have been nervous about. It looks like at least Europe has stabilized and is now starting to grow," Nachman said.
Sales in North America rose 19.2 percent to $837 million. Research and development spending jumped 53 percent in the quarter.
Shares of Canonsburg, Pennsylvania-based Mylan were up about 4 percent at $24.88 in afternoon trade on the Nasdaq. They touched a year-high of $24.94 earlier in the day.

THE Mayor of Redbridge has thanked the borough?s military staff for their service during the Olympic and Paralympic Games.
Councillor Muhammed Javed hosted a celebration event at Valentines Mansion in Ilford on Monday where he paid tribute to the armed forces who were based at Hainault Forest Country Park and the Gordon Road TA Centre in Ilford during the Games.
The theme of the Valentines Mansion event was young people, with military and police cadets rubbing shoulders with serving officers recently returned from Afghanistan.
Cllr Javed, told the troops: " We were delighted to be able to welcome you all to the borough and are grateful to the important role you played."
Council leader, Keith Prince, also attended the event and announced the council is looking to enter into the Armed Forces Community Covenant, a voluntary statement of mutual support between the civilian community and local armed forces communities.
The covenant would encourage people to support the Armed Forces community in their areas and recognise and remember the sacrifices they have made.

Prop. 39 would recoup $1 billion California lost in tax breaks
SACRAMENTO ? At the heart of Proposition 39 is a way to recoup $1 billion the state gave up in tax breaks for Silicon Valley companies and other big California corporations as part of a back-room deal.
But the measure isn't aimed at those businesses.
A late-night pact three years ago allowed firms to choose between two ways of computing their state income tax. Not surprisingly, they have opted for the lower result. Proposition 39 would eliminate that choice, taxing all businesses with a single formula and returning $1 billion to the state.
"This is a loophole that really shouldn't be there," Tom Steyer, a San Francisco Bay Area hedge fund manager who has bankrolled the campaign with nearly $22 million of his personal fortune, said at a talk in Sacramento last month.
The $1 billion, which would help balance the budget and pay for a new green-energy program, won't come from the businesses that won the tax advantage; those companies would keep the money. Under Proposition 39, out-of-state businesses that make such everyday products as cars, tissues and hair conditioner would pay more.
"These are not the companies that saw their tax bills plummet," said Dorothy Rothrock, vice president for government affairs at the California Manufacturers and Technology Assn., which opposes Proposition 39.
The state used to tax all business income using a combination of California property, workforce and sales. That meant firms based in California, with significant in-state property and employee rolls, paid more than corporations whose assets were elsewhere ? and thus leavened their tax bills.
In 2009, a group led by high-tech companies including Genentech, Cisco and Apple asked the Legislature for new rules that would tax sales alone, lowering their own liability and increasing that of companies based elsewhere. But lawmakers were scrambling toward a budget deal and, according to legislative staff and lobbyists, reluctant to raise levies on such businesses as General Motors, Kimberly-Clark and Procter & Gamble.
So they simply adopted the new rules in addition to the old formula and gave companies a choice.
The tech companies' move was part of a national lobbying effort to lower the taxes they pay. They have threatened to lay off workers in many states where they have operations unless a different income tax formula were adopted. Additionally, they have been pushing Congress for other more lenient tax rules.
A company's taxes are confidential. But the state released data showing that nearly a third of the 2009 tax break was shared by nine companies, which each received savings averaging $33.1 million. Joining Silicon Valley in lobbying for the change were some Hollywood studios with large California assets.
The campaign for Proposition 39, however, gives the impression in advertisements and news releases that out-of-state firms got the windfall. One release said non-California firms persuaded lawmakers in 2009 to give "tax breaks to companies who ship jobs out of state."
Economists differ on the fairness of taxing all businesses on sales alone. Some argue that it encourages companies to hire and expand in California, because a bigger workforce would no longer result in a bigger tax bill. Others say the method enables firms to avoid paying for the roads, universities and other state services they use and note that some tax-avoidance schemes, such as the shifting of income into shell companies, have followed.
Even some key supporters of Proposition 39 apparently doubt that locking in the 2009 tax breaks would help California's economy. Unions and tax experts now working with Steyer had campaigned for an earlier ballot measure to force all companies back to the old, three-factor tax. That measure failed in 2010 amid intense, well-funded opposition from the tech companies and studios that would not be affected by Proposition 39.
Under Proposition 39, $500 million raised by the measure would go to a new Clean Energy Job Creation Fund, paying for energy-efficiency retrofits in public buildings and providing loans for other efficiency projects. The remaining money would go to the state's general fund. After five years, all the money would go to the general fund.
Steyer's firm, Farallon Capital Management, has millions of dollars invested in alternative-energy projects. Steyer has said he would not benefit financially if Proposition 39 passes.
"I cannot think of a way this is going to help me," he said. "The only people who are going to make money out of this are the people who do construction, which I have no interest in, and the people who are going to be supplying the well-known technologies ? to retrofit these buildings, which I have no interest in."

In general, skiing as a whole can always be dangerous and challenging. There is the snow skiing, the water skiing, and now another form and type of skiing? the heli skiing.
Heli skiing comes from the word skiing and helicopter. The literal analysis of the word would come up with the literal and practical definition for this recreational or sports acivity.
Heli skiing is a term used to denote the practice or action of Alpine skiing with the use of the helicopter. Why the helicopter? You might ask.
The helicopter
Helicopter is used in heli skiing so the skier can be able to gain extreme altitude that would be impossible to be gained or attained by any person without the help of the helicopter.
Heli skiing enables the skier to ski coming off from different and various starting points. Skiing in very remote areas can also be made possible by heli skiing.
As such, heli skiing can be safely and appropriately classified as a very extreme sports. Because heli skiing is mainly done in remote and unlikely places or areas for skiing, the dangers of avalanches is very evident.
Heli skiing is also never free of the dangers posed by the existence of rocks and trees.
The helicopter used for helis skiing is also not the ordinary helicopter used in the modern times. They are specially designed and are used to carrying out the task of helping heli skiers lift up and ski at great heights.
A short history
Heli skiing is an extreme sport developed and introduced in April 1965 in Canada by Hans Gmoser.
Hans Gmoser is an Austrian who migrated to Canada in the 1950s to pursue and chase after greener pastures. Ironically, the man found whiter pasture, because the Canadian state where he got into turned out to be covered with thick snow.
By that time, there are a number of Austrians who went up and posed on top of Mt Everest in the Himalayas. The thrill and excitement aroused the national pride in the extreme sports fanatic, Mr Gmoser.
To have his own participation in the emerging Austrian pride for the heights, Mr Gmoser devised and designed an extreme recreation or sports to lift snow skiers in the Bugaboo Mountains.
Because no one has ever tried it before, he introduced skiing using helicopters to lift up the skier to greater altitudes.
The result was an extreme fun and thrilling exercise. Hel skiing was born.
The modern times
The modern times is characterized by extreme recreation and sports. That is because most people are earning their living through the corporate scene.
Most people are engaged in seats and in front of computers in general to earn their living. That is why the opportunity of going out and sweating it all out through extreme activities in the great otdoors thrill most people.
Heli skiing has it all and more. It can also be too risky and deadly. Experts and less-gutsy people stay away from it because the activity is truly not one to keep your visceral parts at peace.

It's not quite what we expected, but Apple has just introduced us to a new, 4th generation iPad at its event in San Jose, California today. It's essentially a hardware refresh for Apple's 3rd gen slate, as it packs new A6X silicon with quad-core graphics that the company claims provides double the performance of the old A5X chip. The new iPad also gets dual-band 802.11 a/b/g/n WiFi, expanded LTE compatibility (including Sprint and KDDI), a 720p FaceTime camera on the front and the new image processor first seen in the iPhone 5. Of course, it also gets the reversible Lightning port that debuted on on the iPhone, and will be available in both black and white. Pricing stays the same as its predecessor, with a 16GB WiFi version for $499 and a 16GB model with cellular data on board costs $629. Interested? Fact check: New Obama ad inflates jobs claim
In a new TV ad, President Obama makes an inflated claim to have added 5.2 million new jobs. The total added during his time in office is actually about 325,000.
In the ad, the president says ?over 5 million new jobs? while the figure ?5.2 million? appears on screen. But that?s a doubly misleading figure.
- Viewers would need to pay close attention to the on-screen graphic to know that the ad refers only to employment gains starting in March 2010, omitting the 4.3 million jobs that were lost in the first year of Obama?s term.
- And there?s no way a viewer would know that the total counts only private-sector jobs, omitting continuing losses in government employment.
According to the most recent employment figures from the Bureau of Labor Statistics, the economy has eked out a net gain of 325,000 jobs since January 2009, when Obama took office. And that?s giving credit for roughly 386,000 jobs that the BLS has announced, on a preliminary basis, that it will be adding to this year?s employment totals next year, as a result of its routine annual ?benchmarking? analysis.
Looking only at private-sector jobs, it?s true that the total has risen just under 5.2 million since February 2010 ? provided that credit is given for roughly 453,000 private-sector jobs to be added next year through the BLS benchmarking process. But over Obama?s entire term, those private-sector jobs have gone up only 967,000, even counting benchmarking additions.
Other claims in the ad are essentially accurate: Exports are rising; home values have begun to recover; U.S. automakers are making profits, for example. And viewers can judge for themselves how they feel about the ?plan for the next four years? that the president briefly outlines in the ad, which is couched in broad generalities.
But viewers who follow the ad?s invitation to visit an Obama website for further information will find some false and misleading claims. There, the campaign, for example, states that ?Mitt Romney criticized the end of the Iraq war as ?tragic,? and has offered no plan withdraw our troops from Afghanistan.?
In fact, as we?ve reported before, Romney did not call the end of the Iraq war ?tragic.? He used that word to describe the president?s pace of troop withdrawal, not ending a war. And more important, there is no longer any difference between Romney?s position and Obama?s plan to pull all U.S. combat troops out of Afghanistan by the end of 2014. Romney, whose position has evolved from criticism to unqualified acceptance, said during the final presidential debate on the night before the ad was released: ?[W]hen I?m president, we?ll make sure we bring our troops out by the end of 2014.?

The Wacky World of Multiple Offers
Today?s Boston real estate market is highly competitive. There is the biggest shortage of inventory in a decade, and the historically low mortgage rates are fueling high buyer demand. This is leading to many competitive bidding situations for desirable properties in high demand areas of the city.
Great news for sellers, right?
Yes?.but?.
Multiple offers are a tricky situation for sellers. It is a nice ?problem? to have, but the situation needs to be handled delicately and transparently for all parties involved so it doesn?t blow up in your face.?Some age old clich?s come to mind?..
Hogs get slaughtered.
One in the hand is sometimes better than two in the bush.
But multiple offers can yield a great end net result for a seller if handled properly.
Let?s say you?ve?valued your home perfectly?and it has created multiple offers (how to do just that will be the topic of a future post).
The bottom line is that buyers detest being in a multiple offer situation. They feel as though they are getting ?bullied?, and the seller must walk a fine line between maximizing their own personal needs, and not simultaneously turning off buyers and creating ill will ? especially considering the transaction will be ongoing for a month or more even after the bidding stops.
On several?occasions?I?ve seen what seemed like advantageous multiple offer situations just evaporate with all the buyers walking away from a deal ? simply by the way it was handled by the seller and their agent.
How do you prevent that from happening?
?
The first thing to consider is that an offer is not just price. The terms of the deal matter just as much.
- How strong is the buyer financially? Is their loan assured?
- How experienced are they emotionally (1st timers versus seasoned real estate buyers)?
- Do the closing dates work?
- Is there a?discernible?difference in their respective contingencies?
All of these issues are very important when weighting your options as a seller.
Assuming there are multiple offers that are similar in price and terms, then a common, and effective strategy is to ask for everyone?s ?best and final? offer by a specific time (typically 12-24 hours from receiving the multiple offers). ?I have always found that the best strategy when asking for a ?best and final? is foremost to ensure that they are both (or all) worthy of putting people in a ?best and final? situation. There is no need to force everyone into an emotionally volatile situation if there is 1 party that is a clear cut, far and away a ?better? option than all the other offers. Leveraging the competitive landscape is a great thing, if done properly; if not, it can be disastrous.
The one element of this process that I am adamant with my seller clients about is that ?best and final? is a one-time deal. I think it is a questionable strategy to ask for ?best and final? offers, and then try to go back and negotiate more. Yes, we all know there are exceptions to every rule, but I think this shows a lack of courtesy and credibility that can end up having a negative impact on a transaction, versus helping it.
Another factor for sellers to remember is that the market is the best indicator of value. If you have a hot new listing and get lucky enough to get in a multiple offer situation, then there is no more opportune time to learn the true value of your property?.even if none of the offers are at, or over the asking price. Buyers will often stretch their budgets and drop any ?hardline/low ball? negotiating tactics, if they know there are other interested parties. After all, they have to. ?That being said, if there are multiple offers, and the best one is still 3-5% below the asking price, then the odds are that is still going to be the best offer for the property. Thinking other buyers may come along in a week or 2, and be as aggressive is not a wise assumption.
At the end of the day use your ?newness? on market and the competition buzz created by multiple offers to get the best deal you can for yourself as the seller. Just be disciplined enough to realize the context of this fortuitous occurrence.? Treat people ethically, fairly, and appreciate that multiple offers typically will only happen once, and knowing how to handle it will ultimately help you achieve the most optimal end result.

China prepares send-off for late Cambodia ex-king
PHNOM PENH, Cambodia (AP) ? Chinese police escorted Cambodia's former King Norodom Sihanouk's body from a Beijing hospital to the airport Wednesday morning for its return to Phnom Penh, where tens of thousands are expected to line a mourning route.
Sihanouk died Monday at age 89 of a heart attack in Beijing, where he had been receiving medical treatment since January.
Beijing traffic authorities cleared several roads and a highway as a bus decorated with yellow flowers and apparently carrying Sihanouk's body traveled to the airport with a few dozen black cars and minibuses.
Chinese state television carried live coverage of the procession while Chinese flags at Tiananmen Square and other key locations in the capital flew at half-staff.
After Sihanouk's body is returned to Cambodia, at least 100,000 people are expected to line the route from the airport to the Royal Palace, where it will lay in state during a week of official mourning.
Prime Minister Hun Sen has ordered all radio and television stations not to play inappropriately lighthearted music or programming that might disrespect the late monarch, who abdicated in 2004 in favor of his son Sihamoni.
Sihanouk's body will remain in the palace for three months, during which time the public can pay respects before it is cremated according to Buddhist ritual.
Nearly 100 Buddhist monks and nuns chanted and prayed for Sihanouk at a ceremony Tuesday at a pagoda near the Royal Palace.
"As Buddhists, we believe that our chanting and praying will help send the soul of our beloved king-father to rest in peace and be quickly reborn," said Ngoun Pheadkey, a 22-year-old Buddhist monk. He added that the ceremony was also to express gratitude to the former king for his leadership and legacy.
Bunches of flowers lay on the sidewalk against the palace walls. Several dozen people, mostly older, traveled into the capital from other provinces after hearing of Sihanouk's death.
"All the people in Kampong Chhnang province were very upset and full of regret when they heard that he had died," said Pen Sominea, 50, a cook. "Everybody wishes he had not died now and that he could have lived longer."
Sihanouk was the last surviving Southeast Asian leader who pioneered his nation through postwar independence. Like U Nu of Burma ? now called Myanmar ? and Sukarno of Indonesia, he tried to steer his country on a neutralist course during the Cold War.
Eventually, however, his country became enmeshed in the conflict in neighboring Vietnam, leading to his first fall from power and culminating in the murderous rule of the communist Khmer Rouge in the late 1970s, during which about 1.7 million of his countrymen perished.
His legacy became tainted because in an effort to regain his political influence, he made common cause with Khmer Rouge, though the regime never yielded power to him and killed five of his children.
After the Khmer Rouge were ousted, and Sihanouk regained the throne in 1993, he rebuilt his reputation as the conscience of his country. But Hun Sen, a tough and canny politician who had defected from the Khmer Rouge, undercut his influence, and a discouraged Sihanouk gave up the throne eight years ago. Sihanouk spent much of the rest of his life in China.
The passage of time and Sihanouk's retreat into quiet retirement in China made the once-dynamic monarch more of a historical figure than a contemporary statesman, but his passing was noted internationally.
U.N. Secretary-General Ban Ki-moon and the United States sent condolences.
From neighboring Thailand ? another of the few remaining monarchies of Asia ? came a note of sympathy from 84-year-old King Bhumibol Adulyadej, who like Sihanouk gained the throne in the 1940s.
An effusive tribute came from President Francois Hollande of Cambodia's one-time colonizer, France. The countries retain friendly ties.
"I salute the memory of a great man who embodied the destiny of his country and his people, through the hardships of the most terrible events of the twentieth century, and the construction of peace, where he always found France at his side," Hollande said in a letter.

CHARLOTTE, N.C. (AP) ? Dale Earnhardt Jr. visited a noted concussion specialist in Pittsburgh on Tuesday as part of the planned rehabilitation program to get NASCAR's most popular driver back in a car.
Hendrick Motorsports confirmed that Earnhardt met with Dr. Micky Collins, the clinical and executive director of the UPMC Sports Medicine Concussion Program.
Collins is one of the leading experts in the diagnosis, treatment and rehabilitation of athletes who have suffered concussions. He and Dr. Mark Lovell developed the ImPACT test now used by many professional sports leagues, including the NFL, to assess concussions and determine when an injured athlete can safely return to play.
Earnhardt was accompanied by neurosurgeon Dr. Jerry Petty, the doctor who would not clear Earnhardt to race last week because of two concussions suffered over the past six weeks. Earnhardt did not seek treatment for the first one, suffered in an Aug. 29 crash at a tire test at Kansas. He went to see Petty last week because of a lingering headache following a 25-car crash in the Oct. 7 race at Talladega.
Earnhardt missed Saturday night's race at Charlotte, and will miss this weekend's race at Kansas, too. The injury snapped his streak of 461 consecutive starts, which was the fifth longest active streak in the Sprint Cup Series.
Petty said last week that Earnhardt could not be cleared to race again until he's gone at least four days headache-free, then goes through testing. After that, Earnhardt would get back in a car and "drive a lap or two and see how that goes, and if that goes well, we'll probably clear him to race," Petty said then.
After visiting UPMC on Tuesday, Earnhardt, a rabid Washington Redskins fan, had lunch at the Pittsburgh Steelers facility. The Steelers tweeted a picture of Earnhardt meeting coach Mike Tomlin in the lunch room, calling him "a surprise lunch time guest."

Bow Hunting - Learning To Improvise
Years ago, my bowhunting motto was all about stalking game, and nothing else. I went into every (western) hunt expecting this. I preferred to hunt this way because I find it more exciting, gratifying, physically challenging and more controllable, as I can take the hunt where I suit fit, instead of sitting in ambush and waiting for something to happen. Of course, the fringe benefit of this tactic is exploring semi- to wide-open country where it happens to work bestcountry that I find full of mystery and raw beauty.
But, for as much as I love hunting like this, it doesn't always prove to be productive. In certain situations, other methods will simply prove more useful; and the more I fight it, the worse off I am as a hunter.
Of course, it took many unsuccessful hunts for this realization to finally break though. Eventually, I got tired of making the hunt such a battlefield, especially on those do-it-yourself adventures where game is sparser and conditions are extra rough.
Today, I approach all my hunts with a much more open mind. To do this requires lots of preparation in gear and knowing which technique to employ at the right time.
Also, to prevail, you must learn to read hunting conditions like a wise financial expert predicting the ups and downs of the stock market. This could take years of experience and knowledge of animal behavior, or you can learn it from what veteran hunters tell you. But, once you learn this, you'll begin putting the pieces together nicely and visualizing the best setups for success. You'll discover a new art in bowhunting.
For example, on nearly everyone of my western hunts now, at least the ones where I know my quarry can be taken using multiple methods, I prepare myself for stalking, still-hunting, calling and ground- and tree-stand hunting. I even pack a mountain bike in those situations where it can be of use to access virgin hunting ground. Packing light is great, but nowadays I throw it in, because I just might need it. Believe it or not, but one missing item in your repertoire of gear can hurt you badly.
During the off-season, I remind myself of all the important fundamentals that go along with each hunting tactic I'll use, too, so I can hit the ground running, so to speak. I'll review any notes and memories from past hunts, and think about any negative obstacles I could encounter. I'll even go through that not to-do list I've learned from years of failure, which seem to skip my mind each season.
I'll think about things, over and over again, and replay one possible scenario from the next. I want my mind well prepared and hot for the hunt right from the get go. Sloppy habits cause mistakes and unproductive hunting, and time is always of the essence on my hunts.
My last trip to California to hunt coastal blacktail serves as a good example.

Vilma, NFLPA take bounty matter back to court

NEW ORLEANS (AP) ? If the Saints decide Jonathan Vilma is ready, the embattled linebacker will take the field in Tampa Bay on Sunday for the first time this season.
It might also be the last time, depending on how things go at NFL headquarters and in federal court.
On Monday, Vilma again asked a federal judge to overturn his recently re-issued suspension in the NFL's bounty probe of the Saints, and the NFL Players Association made a similar request on behalf of three other players.
None of the four players' suspensions are currently being enforced, but that could change as early as next week. NFL Commissioner Roger Goodell has scheduled the players' appeal hearings for Oct. 23.
The players want U.S. District Judge Ginger Berrigan to begin considering their cases now so she may be ready to rule by the time the NFL's appeal's process concludes.
Vilma's latest filing said Goodell conducted a "farcical review" of his previously overturned disciplinary action before ruling last week that the Saints linebacker would remain suspended for the season.
The NFL did not immediately respond to requests for comment, deferring instead to its legal response which is due in federal court Wednesday.
Vilma is facing the longest suspension of four players punished in connection with what the NFL has said was a pool that rewarded Saints players with improper cash bonuses for hits that injured opponents.
Saints defensive end Will Smith was docked four games, free-agent defensive lineman Anthony Hargrove seven games and Cleveland linebacker Scott Fujita one game. Vilma's and Smith's suspensions remain unchanged from what Goodell initially handed down. Hargrove's suspension was reduced by one game and he was given credit for five games missed as a free agent. Fujita's ban was reduced from three games.
The NFL Players Association is representing Smith, Hargrove and Fujita. Vilma has his own lawyers, Peter Ginsberg and Duke Williams.
The players said Goodell has continued to abuse his power and demonstrate bias, leaving no hope for a fair process that would respect their "industrial due process rights."
They also asked Berrigan to bar Goodell from handling any further action in the bounty matter and appoint a neutral arbitrator.
"The commissioner of a professional sports league is not exempt from the requirement that he or she be impartial when serving as an arbitrator, and courts vacate arbitration awards when a commissioner falls short of the required standard of impartiality in considering a particular matter," Vilma's new legal papers said.
In the meantime, Vilma is eligible to return to the Saints' lineup.
The linebacker has been on the club's physically unable to perform list since shortly after his initial suspension was overturned by an NFL appeal panel on Sept. 7, but now that the first six weeks of the season have passed, the Saints could activate him as early as Tuesday.
While Saints coaches declined to confirm such plans, defensive coordinator Steve Spagnuolo said it was his understanding Vilma will "be able to practice on Wednesday, which I think is a great thing for our football team and our defense."
Curtis Lofton has taken over Vilma's middle linebacker spot, but Spagnuolo said there is room in the lineup for both.
"Let's get them out there, practice and get ready with the one focus being figuring out what's best to help our team beat Tampa Bay," Spagnuolo said. "That will be the No. 1 focus this week with nothing else in sight other than that."
Fellow linebacker Scott Shanle said it would be difficult for a player to adjust to the Saints' new defense in one week of practice, but added that Vilma might be an exception.
"In the 10 years I've played he's the smartest linebacker I've played with," Shanle said. "It was talked about a lot after the (2010) Super Bowl that it was Peyton Manning and Jonathan Vilma in an audible contest and Vilma consistently won, and our coaches always had that trust in him. So when you can get a player like that back, it's a huge boost."
Of course, if the Saints do get Vilma back on the field this weekend, they could still lose him next week.
All four players punished in the bounty probe have asked Goodell to recuse himself from the NFL appeals process, but he has so far refused.
The NFLPA pointed out in its latest motion that although Goodell was given the power in the league's current labor agreement to discipline players for conduct detrimental to football, he may only do so if he complies with "governing legal standards."
The union said Goodell violated those standards by talking publicly about the players' alleged wrongdoing before the disciplinary process began, and by failing to consider conflicting witness testimony or mischaracterizations of evidence by league investigators.
"It is startling that the Commissioner has damaged the careers and reputations of the Players on such scant, contradictory and incredible sources," the NFLPA said.
A three-member appeals created by the NFL's labor agreement vacated the initial suspensions on Sept. 7 and told Goodell he needed to clarify the basis for his rulings. The panel noted that punishments should not have anything to do with cash paid out of the Saints' pay-for-performance pool, because an arbitrator other than the commissioner is supposed to handle such salary cap violations.
The latest legal filings point out that Goodell repeatedly mentioned pay-for-performance allegations as part of the basis for the initial punishment, and that the commissioner's decision to maintain similar suspensions highlights the lack of fairness in the process.
Saints coaches and players have acknowledged the existence of a pool that both fined players for penalties and offered rewards for big plays, including big, non-penalized hits that may have resulted in opposing players leaving games for a play or longer.
Goodell has stated that in their acknowledgement of the pool, the Saints have admitted they encouraged hits that were shown to have injured opponents. Regardless of intent, Goodell said, such a program is intolerable because it sends the message that hits that hurt opponents deserve a reward, and that can affect how players on team approach subsequent games.
Vilma and the NFLPA initially filed suit in July, but the matter was placed on hold when the NFL appeal panel vacated the initial player suspensions on technical grounds and the disciplinary phase started over.

Corrosion linked to 2011 Chevron refinery fire
SAN FRANCISCO (AP) ? Corrosion that went unchecked ? the suspected cause of a fire at Chevron Corp.'s Richmond refinery in August ? has been linked to a fire at the plant in October 2011, the San Francisco Chronicle reported Sunday (http://bit.ly/OzFQcu).
According to state inspection documents obtained by The Chronicle, a state Division of Occupational Safety and Health inspector who investigated the smaller 2011 fire documented allegations from two workers of corrosion at the refinery.
The 2011 fire took place during a scheduled maintenance shutdown and was quickly extinguished.
"We're afraid something is going to fall through the cracks," one worker told Cal/OSHA safety inspector Carla Fritz, who went to the plant to investigate the fire last November.
"We're concerned about increased corrosion ? we've increased temperatures and increased rates, and it takes a toll on the equipment," said the worker, who was identified in Fritz's notes as head operator of the lube oil plant ? the most senior of a 20-member operator crew.
Cal/OSHA said in a statement that a violation notice was not issued to Chevron over the 2011 fire "because the problem alleged and potential hazard had been already identified and corrected."
The Chronicle obtained Fritz's notes under the state Public Records Act. State officials redacted the names of Chevron employees she interviewed.
A Chevron spokesman told the Associated Press that the 2011 fire was contained in a furnace in the lubricants plant, and that the company took appropriate actions afterward to protect the safety of its employees and facilities.
"We immediately responded, shut down the affected operations, evacuated all non-essential staff, and successfully contained the incident," Sean Comey said in a statement.
He added that workers at Chevron have the authority to stop any operation, without any repercussions, if they believe people or the environment are in danger.
Another fire struck the refinery on Aug. 6, creating a huge plume of black smoke and sending thousands of people to hospitals with health complaints.
Chevron later said it was stepping up inspections after it was determined that the blaze was caused by a failure in a five-foot section of an old pipe.

Specter rose to prominence in the 1960s as an aggressive Philadelphia prosecutor and as an assistant counsel to the Warren Commission, developing the single-bullet theory that posited just one bullet struck both President Kennedy and Texas Gov. John Connally ? an assumption critical to the argument that presidential assassin Lee Harvey Oswald acted alone. The theory remains controversial and was the focus of Oliver Stone's 1991 movie "JFK."
In 1987, Specter helped thwart the Supreme Court nomination of former federal appeals Judge Robert H. Bork ? earning him conservative enemies who still bitterly refer to such rejections as being "borked."
But four years later, Specter was criticized by liberals for his tough questioning of Anita Hill at Clarence Thomas' Supreme Court nomination hearings and for accusing her of committing "flat-out perjury." The nationally televised interrogation incensed women's groups and nearly cost him his seat in 1992.
Specter was Pennsylvania's longest-serving senator when Democrats picked then-U.S. Rep. Joe Sestak over him in the 2010 primary, despite Specter's endorsements by President Barack Obama and other Democratic leaders. Sestak lost Specter's seat to conservative Republican Rep. Pat Toomey by 2 percentage points.
A political moderate, Specter was swept into the Senate in the Reagan landslide of 1980.
He took credit for helping to defeat President Clinton's national health care plan ? the complexities of which he highlighted in a gigantic chart that hung on his office wall for years afterward ? and helped lead the investigation into Gulf War syndrome. Following the Iran-Contra scandal, he pushed legislation that created the inspectors general of the CIA.
As a senior member of the powerful Appropriations Committee, Specter pushed for increased funding for stem-cell research, breast cancer and Alzheimer's disease, and supported several labor-backed initiatives in a GOP-led Congress. He also doggedly sought federal funds for local projects in his home state.
The former Democrat was not shy about bucking fellow Republicans.
In 1995, he launched a presidential bid, denouncing religious conservatives as the "fringe" that plays too large a role in setting the party's agenda. Specter, who was Jewish, bowed out before the first primary because of lackluster fundraising.

Martin Lewis is head of the Independent Student Finance Taskforce and has put together a ?mythbuster? about student loans on his website. He has recently dealt with two issues which I believe require a bit more comment and detail.
The first relates to the government?s ability to change the terms on repayment; the second to whether we should replace reference to ?loans? and ?debt? with ?contribution?. I?ll offer my thoughts on each in turn.
The ?Mythbuster? has changed recently to add a final question, Question 23: ?Can the system be changed once I?ve started??
The early days of this blog I covered a discussion between Martin and myself on whether this question needed to be addressed. I?m glad to see that this question is now treated explicitly.
The government can change the terms for existing borrowers and this is something that I have spent the last year writing about.

It?s important to understand Parliament is omnicompetent. In other words, it?s completely free to make and change rules made in the past. This means there is no 100% guarantee the system will remain unchanged for the 30 years until you?re clear. It?s worth being aware this is a risk factor.
This point is further developed on a blog post entitled, ?Once I?ve got a student loan can the government change the terms??
?There is no way to bind a future parliament. So the best we can do, and indeed what NUS is calling for, is to ensure that this must be done via legislation (ie, parliamentary vote) rather than delegated legislation (ie, a minister allowed to make decision with authority of parliament, without? a vote).
If this were in place it would certainly slow down changes and make it more difficult, and that wouldn?t be a bad thing.
Now I agree with both these points but we need to be clear.
Changes to terms and conditions on loans do not require Parliament to implement new legislation. Such amendments are executive matters ? the government of the day, in most cases the relevant Secretary of State, has been granted the powers to set these terms and conditions using secondary legislation. (This distinction depends on differentiating Parliament and its legislative function, from the government and its powers to make operational or executive decisions).?
That is, the relevant point is not that Parliament is ?omni-competent? as per the first quote from Lewis, but rather that power has, as he puts it in the second, been ?delegated?.
In fact, the coalition government used its current parliamentary majority to pass the 2011 Education Act. This primary legislation removed the clauses fixing low interest rates on student loans and replaced them with clauses that gave the executive the power to set rates up to commercial, ?market rates? (or higher in certain circumstances): where rates are exactly set within those parameters is now an administrative matter. The same executive powers extend to the repayment threshold, the repayment rate above that threshold and the write-off of outstanding loan balances.
Clauses in the individual Student Loan Agreements provide no protection.
??You must agree to repay your loan in line with the regulations that apply at the time the repayments are due?and as they are amended. The regulations may be replaced by later regulations.? (p. 8)
The key word there being ?regulations? as opposed to ?legislation?.
I do not believe this current situation is acceptable and,one way or another, borrowers need more protection. The point being, as Lewis seems to suggest, to put impediments and checks in the way of executive decisions so as to insist on ?scrutiny and the possibility of contestation, whether legal or parliamentary.
Now, with regards to what we call ?income contingent repayment loans?, I think we should stick with loans. They do have features that make them ?like a tax? but they are loans, and, for example, will be pursued as such if you move abroad.
I do not believe it is the terminology that is putting people off. Potential applicants and those who have turned down offers are more likely to be assessing whether a 30-year ?contribution? is worth it and likely have to mind one huge issue that seems to escape most commentators, including Lewis here.
Student loans are not the only debts that graduates have.
They also have bank loans, credit cards and overdrafts: the latter in particular may have far less generous repayment terms, sometimes requiring balances of thousands of pounds to be cleared within a year of graduation.
It is important to note that maintenance loans are not designed to cover annual costs of living. As the government confirmed in July:
?It has been a longstanding principle of student support that maintenance grants and loans are generally paid as a contribution towards living costs rather than to cover them in their entirety.?
Student accommodation in London is now extremely expensive and on its own will almost entirely erode the maximum loan available.
An entirely rational aversion pertains to the conditions subtending full-time study.
This needs to be addressed first, before we quibble about what the scheme is called.

Sitting around compromises health of people- even if they meet typical physical activity guidelines
A new study led by the University of Leicester, in association with colleagues at Loughborough University, has discovered that sitting for long periods increases your risk of diabetes, heart disease and death.
The study, which combined the results of 18 studies and included a total of 794,577 participants, was led by Dr. Emma Wilmot, a research fellow in the Diabetes Research Group at the University of Leicester. It was done in collaboration with colleagues from the newly established National Institute for Health Research (NIHR) Leicester-Loughborough Diet, Lifestyle and Physical Activity Biomedical Research Unit and was published in Diabetologia, the journal of the European Association of the Study of Diabetes.
According to the study, those who sit for long periods have a two fold increase in their risk of diabetes, heart disease and death. Importantly, associations were independent of the amount of moderate-to-vigorous physical activity undertaken, suggesting that even if an individual meets typical physical activity guidelines, their health may still be compromised if they sit for long periods of time throughout the day.
Dr Wilmot, a Clinical Research Fellow in Diabetes and Endocrinology based at the Leicester Diabetes Centre, Leicester General Hospital, said: "The average adult spends 50-70% of their time sitting so the findings of this study have far reaching implications. By simply limiting the time that we spend sitting, we may be able to reduce our risk of diabetes, heart disease and death".
"Our study also showed that the most consistent associations were between sitting and diabetes. This is an important message because people with risk factors for diabetes, such as the obese, those of South Asian ethnic origin, or those with a family history of diabetes, may be able to help reduce their future risk of diabetes by limiting the time spent sitting. "
Professor Stuart Biddle, of Loughborough University, and a co-investigator on the study, said: "There are many ways we can reduce our sitting time, such as breaking up long periods at the computer at work by placing our laptop on a filing cabinet. We can have standing meetings, we can walk during the lunch break, and we can look to reduce TV viewing in the evenings by seeking out less sedentary behaviours."
Professor Melanie Davies, Professor of Diabetes Medicine at the University of Leicester and honorary consultant at University Hospitals of Leicester is a co-investigator and Director of the NIHR Leicester-Loughborough Diet, Lifestyle and Physical Activity Biomedical Research Unit. She said:
"This paper has a very important message for the public but also for health care professionals - namely that being sedentary is common and dangerous for our long term health, particularly for diabetes and cardiovascular disease, and that this link appears to be over and above other lifestyle factors such as our diet and physical activity."
